1. Who These Terms Apply To

These Terms of Service ("Terms") govern your access to and use of the website myhealingheartscommunity.com and all courses, programs, community spaces, and services offered by Living in Gratitude with TLC ("we," "us," or "our"), founded by Terri L. Chaplin, based in Tampa, Florida.

By creating an account, enrolling in a course, or using any part of our services, you confirm that you are at least 18 years old and agree to these Terms.

2. Our Services

Living in Gratitude with TLC offers the following services through our Healing Hearts Community platform (hosted on Thinkific):

• Self-paced online courses on grief, healing, and personal growth
• Professional development courses and certification programs for grief companions and helping professionals
• Virtual group support (Healing Hearts SharedCircle)
• Private grief companioning (Healing Hearts Pathway)
• Annual in-person retreat (Heart of Grief Women's Retreat)
• Free educational resources, guides, and webinars

We reserve the right to modify, add, or discontinue services at any time with reasonable notice.

3. Accounts and Access

To access our courses and community, you will need to create an account. You are responsible for:

• Providing accurate and current information when registering
• Keeping your login credentials secure and confidential
• All activity that occurs under your account

Please notify us immediately at [email protected] if you believe your account has been compromised.

Course access is granted to the individual purchaser only and may not be shared, transferred, or resold.

4. Payments and Refunds

Payments

All payments are processed securely through Thinkific's payment platform (powered by Stripe). Prices are listed in US dollars and are subject to change. You will be charged at the time of enrollment.

Refund Policy

We want you to feel good about your investment. Our refund policy is as follows:

• Self-paced courses: Refund requests made within 7 days of purchase will be considered, provided you have not completed more than 20% of the course content.
• Certification programs: Due to the nature and depth of these programs, all sales are final once the program begins. Please review the program details carefully before enrolling.
• Retreats: Retreat deposits and payments are non-refundable. In the event we must cancel a retreat, you will receive a full refund or credit toward a future event.
• Private companioning: Individual session cancellations require 24 hours' notice. No-shows are charged in full.

To request a refund, please email [email protected] with your name, order number, and reason for the request.

5. Intellectual Property

All content on our website and within our courses — including but not limited to text, video, audio, worksheets, graphics, curriculum, and frameworks — is the intellectual property of Living in Gratitude with TLC and is protected by copyright law.

When you purchase a course or program, you receive a personal, non-transferable license to access and use the content for your own learning. You may not:

• Copy, reproduce, or redistribute course content
• Share your login credentials or course access with others
• Use our content to create competing products or services
• Record or screenshot course videos for redistribution

Violations of these terms may result in immediate termination of your access without refund.

6. Community Standards

Our community spaces are sacred and safe. By participating, you agree to:

• Treat all members with compassion, dignity, and respect
• Honor the privacy and confidentiality of others — what is shared in the community stays in the community
• Refrain from sharing unsolicited advice, diagnosis, or judgment
• Not post spam, promotional content, or irrelevant material
• Not engage in harassment, discrimination, or harmful behavior of any kind

We reserve the right to remove any member from our community for violating these standards, without refund.

7. Not a Substitute for Professional Care

Grief companioning and grief education are supportive and educational services. They are distinct from licensed mental health therapy or clinical counseling. Our services do not diagnose, treat, or cure any mental health condition.

If you are experiencing a mental health crisis, thoughts of self-harm or suicide, or any condition requiring clinical care, we strongly encourage you to seek help from a licensed mental health professional. You can also reach the 988 Suicide and Crisis Lifeline by calling or texting 988.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific outcomes from our courses or programs. Results vary based on individual circumstances, effort, and factors outside our control.

We make reasonable efforts to ensure our content is accurate and helpful, but we make no guarantees regarding completeness, accuracy, or applicability to your specific situation.

9. Limitation of Liability

To the fullest extent permitted by law, Living in Gratitude with TLC and Terri L. Chaplin shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services — including emotional distress, loss of data, or financial loss — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Third-Party Services

Our website and services may include links to or integrations with third-party platforms such as Thinkific, Stripe, EasyWebinar, and social media platforms. We are not responsible for the content, privacy practices, or terms of those third-party services. Your use of them is governed by their own terms and policies.

11. Termination

We may suspend or terminate your access to our services at any time if you violate these Terms or engage in conduct harmful to our community. You may also close your account at any time by contacting us.

Upon termination, your license to access course content ends. We are not obligated to refund any fees paid unless required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

For significant changes, we will make reasonable efforts to notify you by email.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes arising from these Terms shall be resolved in the courts of Hillsborough County, Florida, and you consent to personal jurisdiction in that venue.
