Welcome to Healing Hearts Community. By accessing or using this platform and any services offered by Living in Gratitude with TLC, you agree to be legally bound by the terms and conditions set forth below. Please read these Terms of Use carefully before using our platform. If you do not agree to these terms, you may not access or use the Healing Hearts Community platform or its services.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Living in Gratitude with TLC governing your access to and use of the Healing Hearts Community platform, including all courses, support community features, trainings, and related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you represent that you have read, understood, and agree to be bound by these Terms. If you are accessing the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Living in Gratitude with TLC reserves the right to update these Terms at any time. We will make reasonable efforts to notify you of material changes, such as by posting a notice on our platform or sending an email to the address associated with your account. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

2. Description of Services

Healing Hearts Community is an online platform offered by Living in Gratitude with TLC that provides:

• Self-guided courses, including prerecorded video lessons and accompanying materials
• A support community for members navigating grief, loss, and personal transformation
• Live and recorded trainings and educational content
• Additional resources as made available from time to time

Details about specific course offerings, pricing, and inclusions are described on the Healing Hearts Community website. Living in Gratitude with TLC reserves the right to modify, suspend, or discontinue any aspect of the Services at any time.

3. Important Mental Health Disclaimer

If you are experiencing a mental health crisis, thoughts of self-harm, or a psychiatric emergency, please contact a licensed mental health professional, call or text 988 (Suicide and Crisis Lifeline), call 911, or go to your nearest emergency room immediately.

Participation in our community and courses does not create a therapist-client or counselor-client relationship between you and Living in Gratitude with TLC or any of its facilitators, coaches, or instructors.

4. Eligibility and Account Registration

To access the Services, you must be at least 18 years of age. By using the platform, you represent and warrant that you meet this requirement. The Services are not intended for use by minors, and we do not knowingly collect information from anyone under the age of 18.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Living in Gratitude with TLC immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

You agree to provide accurate, current, and complete information when registering and to keep your account information updated.

5. User Conduct

The Healing Hearts Community is a safe, supportive space. All members are required to use the platform in a manner that is respectful, ethical, and in compliance with applicable laws. By using the Services, you agree not to:

• Harass, intimidate, bully, threaten, or demean other members or staff
• Share another member’s personal information, stories, or disclosures without their explicit consent
• Post content that is abusive, defamatory, discriminatory, or hateful
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to any part of the platform or other users’ accounts
• Upload or transmit viruses, malware, or any other harmful code
• Use the platform for commercial solicitation or spam without prior written consent
• Reproduce, distribute, or publicly display course content without authorization
• Engage in any activity that disrupts or interferes with the Services

Living in Gratitude with TLC reserves the right to remove any content or suspend any member who violates these standards, at our sole discretion and without prior notice.

6. Intellectual Property

All content available on the Healing Hearts Community platform — including but not limited to course materials, video lessons, worksheets, text, graphics, logos, images, audio recordings, and the overall compilation of content — is the proprietary property of Living in Gratitude with TLC or its licensed suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

Your access to the Services does not grant you any ownership rights in the content. You may access and use the materials for your own personal, non-commercial purposes only. You may not copy, reproduce, distribute, publicly perform, modify, create derivative works from, or otherwise exploit any content without the prior written permission of Living in Gratitude with TLC.

7. Payments and Refund Policy

Certain Services require payment. All fees are as stated at the time of purchase. You agree to provide accurate and complete payment information. All refunds are at the discretion of Living in Gratitude with TLC and will be handled on a per request basis. 

Living in Gratitude with TLC reserves the right to change pricing at any time. Price changes will not affect purchases that have already been completed.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you agree to the terms of our Privacy Policy, which is available on the Healing Hearts Community website.

9. Third-Party Links and Content

The Services may contain links to third-party websites or resources. These links are provided for your convenience only. Living in Gratitude with TLC does not endorse and is not responsible or liable for the content, products, services, or practices of any third-party websites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

10. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LIVING IN GRATITUDE WITH TLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Living in Gratitude with TLC does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components, or that any specific results will be achieved through use of the Services. Results will vary based on individual circumstances, effort, and other factors beyond our control.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIVING IN GRATITUDE WITH TLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO LIVING IN GRATITUDE WITH TLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Termination

Living in Gratitude with TLC reserves the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other members or to the community.

Upon termination, your right to access the Services will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, you agree that it shall be submitted to binding arbitration in the State of Florida, in accordance with applicable arbitration rules.

14. Changes to These Terms

Living in Gratitude with TLC reserves the right to modify these Terms at any time at its sole discretion. We will make reasonable efforts to provide notice of material changes by posting an updated version on the platform with a revised “Last Updated” date and, where appropriate, by notifying registered users via email. Your continued use of the Services following the posting of changes constitutes your acceptance of the revised Terms.
